Cablevision HD commercial-false advertising?

Cablevision is running commercials that state their HD channels are FREE. My TV has a QAM tuner and I used to be able to get HD channels on it but they have now scrambled them. I PAY for Cable TV and I have an HD television and I cannot get HD channels without renting a digital cable box for $6.70 a month. When I talked to customer service about the issue they stated that too many people were stealing the signal when it wasn’t scrambled. I also asked about what you can do if you have a TV with picture in picture and they stated you have to rent two boxes in order to watch the higher channels, otherwise you can get channels 2-13.
Is this false advertising, if you have to pay extra for a digital cable box in order to receive HD channels?
